Biographical

Arbitrator, mediator and attorney with nearly 30 years of legal experience in federal court, state court, bankruptcy court, appellate court, and various arbitration forums. Offering online, in-person and hybrid mediation and arbitration. Disputes range from two party disputes to multi-party disputes (including disputes involving 10 or more parties). Amounts in controversy range from $100,000 to in excess of $1 billion. Have served as neutral in many pre-litigation disputes.

Over the last three decades, have served as counsel or neutral in thousands of disputes spanning a breadth of industries and a wide variety of issues, including avoidance actions, banking, bankruptcy, business separations, civil litigation, collections, commercial litigation, construction, consumer, contracts, corporate governance, corporations, credit, director and officer liability, distribution, employment, energy, exploration and production, fiduciary duties, finance, financial services, fraud, fraudulent transfers, healthcare, hospitality, insolvency, insurance, landlord-tenant, lender liability, leasing, limited liability companies, manufacturing, mechanics and vendors liens, natural gas, oil and gas, oilfield services, partnerships, pharmaceutical, personal injury, pipelines and transportation, preference actions, professional liability, real estate, retail, royalties, sales, secured transactions, securities, surety bonds, telecommunications, torts, transportation, and wholesale.

COMMERCIAL & CONSUMER: Represented parties in a wide spectrum of legal issues, including business litigation, business separations, collections, contracts, corporate governance, energy, fiduciary duties, fraudulent transfers, guaranties, health insurance, landlord-tenant, insurance, oil and gas, operating agreements, personal injury, professional liability, representations and warranties, anti-SLAPP, surety bonds, and tortious interference.

CORPORATE GOVERNANCE: Represented parties in corporate governance and fiduciary duty disputes. Advised boards, directors, partners and managers regarding corporate governance and fiduciary duties. Engagements included issues involving corporations, limited liability companies and limited partnerships.

BANKRUPTCY LITIGATION: Represented debtors, creditors, trustees, committees, contract counterparties, defendants, and other parties in interest in chapter 11 bankruptcies and bankruptcy litigation around the country. Representations included companies in energy, oil and gas, retail, real estate, wholesale, refining, manufacturing, financial services, telecommunications, hospitality, pharmaceutical and healthcare sectors, as well as representing creditors, contract counterparties, defendants and other parties in interest. Litigation representations included fraudulent transfer, preference and other avoidance action litigation, as well as claims related to fiduciary duty, employment, contracts, special purpose entities, and corporate governance. In addition, served as court appointed examiner and representative on a section 1114 committee.

ENERGY/OIL & GAS: Represented parties in the upstream, downstream, and midstream sectors, including representing parties with disputes involving joint operating agreements, exploration and production, underground storage tanks, plugging and abandonment, oilfield services, decommissioning, gathering and transportation agreements, working interests and royalty owners, statutory liens, mechanics liens, vendors liens, refining, fiduciary duties, equipment leases and a variety of other issues.

EMPLOYMENT: Represented both employers and employees in disputes involving separation, severance, non-compete, benefits, breach of contract, and a variety of discrimination claims.

Education

Sylvia graduated from Washington University in 1987, cum laude, with a B.A. in Theater. After working for three years in the arts community in Houston, Sylvia went to law school and, in 1993, graduated from the University of Houston Law Center, summa cum laude.

Rates Information

My standard rates for Mediation are $750 per party for a half-day mediation (4 hours or less) or $1,500 per party for a full-day mediation.

My standard rate for Arbitration is $395 per hour, plus if applicable, travel expenses.
